Convicted killer of Aberdeen man seeks new trial

The man convicted of killing 23 year old Brian Beaver of Aberdeen in November 2010 has filed a motion with the Montana Supreme Court seeking a new trial with a new attorney.

A brief filed on behalf of Brian Holm in late May argues District Judge Dusty Deschamps was wrong to twice deny Holm’s request to postpone his trial to give a new attorney time to prepare without holding a hearing to consider his arguments.

Holm alleged his public defender did not hire any experts to testify and did not review all of the available evidence.

Holm was convicted in August 2011 of vehicular homicide while under the influence in the death of Beaver and sentenced to 15 years in prison.
